AMBIL ALIH EDL BUKTIKAN PRINSIP EKONOMI BUKU JINGGA PR TEPAT

KEADILAN mengalu-alukan pengumuman bahawa Kerajaan Persekutuan akan mengambil alih Lebuhraya Penyuraian Timur (Eastern Dispersal Link atau EDL) di Johor Bahru setelah desakan rakyat menentang tol yang membebankan rakyat memuncak.
Tindakan Dato' Seri Najib Tun Razak itu benar-benar mengesahkan prinsip asas tata kelola ekonomi yang disyorkan di dalam Buku Jingga iaitu:

1.     Kerajaan perlu bersifat pragmatik dalam model pembiayaan projek infrastruktur, dengan membandingkan bebanan kewangan yang ditanggung kerajaan secara keseluruhan (termasuk pampasan yang perlu dibayar setiap tahun) dengan jumlah keuntungan yang diperolehi oleh pemegang konsesi swasta;

2.     Kerajaan perlu mengutamakan kebajikan pengguna termasuklah bebanan kepada perbelanjaan harian dalam menentukan perjanjian konsesi bagi projek infrastruktur; dan

3.     Secara amnya, adalah lebih baik jika rakyat tidak dikenakan bayaran jika kerajaan mampu menanggung kos pembinaan dan operasi, kerana ini akan meningkatkan pendapatan bolehguna (disposable income) rakyat yang bila dibelanjakan kelak, bakal merancakkan pertumbuhan ekonomi negara.
Tiga prinsip asas inilah yang mendorang KEADILAN dan rakan-rakan Pakatan Rakyat menetapkan pengambilalihan konsesi tol dengan matlamat menghapuskan tol sebagai salah satu daripada 10 program pertama yang akan dilaksanakan Pakatan Rakyat bila berkuasa kelak.

Ini berasaskan fakta bahawa jumlah bebanan yang ditanggung oleh rakyat dan kerajaan (dalam bentuk tol yang dibayar dan pampasan tahunan kepada pemegang konsesi) adalah jauh lebih mahal daripada kos operasi dan kadar pulangan pelaburan yang munasabah (reasonable rate of return for investment) yang ditanggung oleh pemegang konsesi seperti PLUS.

Ketika Buku Jingga mula-mula dilancarkan dan cadangan ini dibawa oleh Dato' Seri Anwar Ibrahim, seluruh kepimpinan Umno/Barisan Nasional mengkritiknya atas alasan ia tidak mampu dilaksanakan dan akan memufliskan negara.
Tindakan Dato' Seri Najib Tun Razak mengarahkan pengambil alihan EDL sebenarnya mengesahkan bahawa prinsip asas tata kelola ekonomi yang dibawa Buku Jingga boleh dilaksanakan dan lebih bermanfaat kepada rakyat.
Walau bagaimana pun, saya khuatir jika pengambil alihan ini juga adalah satu helah supaya wang rakyat boleh diseludup keluar kepada syarikat-syarikat yang rapat dengan Umno/Barisan Nasional, terutamanya apabila pemegang konsesi EDL adalah MRCB yang rapat dengan Umno.
Kebelakangan ini, ada satu kegilaan oleh Dato' Seri Najib Tun Razak untuk menggunakan dana rakyat dan membeli pelbagai aset dan konsesi kroni yang jumlah urusniaganya mencecah berbilion ringgit. Sebelum ini, dana 1MDB yang dikawal oleh Dato' Seri Najib Tun Razak telah menyempurnakan pembelian dua buah syarikat penjana bebas dari kumpulan yang dikawal Genting dan Ananda Krishnan pada harga keseluruhan melampaui RM7 bilion. Kedua-dua tokoh perniagaan ini sering dikaitkan dengan kepimpinan Umno/Barisan Nasional.

Kesemua urusniaga ini, termasuklah yang terbaru pembelian EDL oleh kerajaan Malaysia dibuat dalam suasana penuh kerahsiaan. Nilaian harganya tidak melibatkan tokoh-tokoh lain yang boleh memastikan rakyat tidak ditipu dan tidak ada unsur-unsur penyelewengan.

Oleh yang demikian, saya mengesyorkan kepimpinan Pakatan Rakyat memberi tumpuan untuk menggerakkan rakyat menuntut dua perkara seperti berikut:

1.     Bila mana prinsip asas tata kelola ekonomi Buku Jingga diterimapakai oleh Dato' Seri Najib Tun Razak dalam pengambil alihan EDL, prinsip itu terbukti boleh dilaksanakan kepada konsesi lebuhraya yang lain. Saya sarankan Dato' Seri Najib Tun Razak umumkan secepat mungkin senarai lebuhraya dan konsesi lain yang juga akan diambil alih oleh kerajaan dalam masa terdekat; dan

2.     Sebuah Jawatankuasa Parlimen (Parliamentary Select Committee) perlu ditubuhkan dalam sidang dewan akan datang untuk mengkaji, menyemak dan memastikan kesemua urusniaga yang melibatkan pembelian aset besar dari syarikat berkepentingan dibuat secara adil dan tiada unsur penyelewengan.
 
KEADILAN akan membawa isu ini ke sidang Parlimen akan datang untuk diberikan perhatian utama.

Pakatan jamin bela hak Melayu dan kaum lain – Anwar

BAGAN SERAI 27 Ogos: Ketua Pembangkang, Datuk Seri Anwar Ibrahim bertegas, hak keistimewaan orang Melayu dan lain-lain kaum akan terjamin jika Pakatan Rakyat (Pakatan) berjaya membentuk Kerajaan Pusat pada pilihan raya umum (PRU) akan datang.

Katanya, antara tawaran Pakatan jika menang pilihan raya termasuk menurunkan harga minyak dan kereta serta membatalkan Perbadanan Tabung Pendidikan Tinggi Nasional (PTPTN).

Ketua Umum KEADILAN itu berkata, rakyat tidak bodoh untuk terus percaya dakwaan Umno BN bahawa negara akan bankrap jika ditadbir Pakatan.
“Rakyat tak bodoh…(Menurut Umno BN) negara akan bankrap (sedangkan) kita bagi fakta,” katanya merujuk tawaran berkenaan ketika berucap pada Ceramah Perdana Demi Rakyat di sini, malam tadi di hadapan kira-kira 4,000 hadirin.

Anwar berkata, semua golongan akan mendapat keuntungan daripada tawaran tersebut, terutama rakyat miskin dan kebanyakannya Melayu.

Beliau turut menyangkal tohmahan sesetengah pihak mengatakan nasib orang Melayu tidak akan terbela di bawah pentadbiran Pakatan.

Menurutnya, KEADILAN, PAS dan DAP bersetuju memberi jaminan untuk terus membela Melayu dan pada masa sama hak kaum lain sebagai warganegara yang sah.

“(Ini kerana) Malaysia tidak akan selamat kalau orang Melayu (sebagai kaum majoriti) tersisih dan tidak kuat,” kata Anwar lagi.

Jelasnya, orang Melayu tidak mendapat pembelaan sebenar di bawah pemerintahan Umno BN yang hanya mengkayakan keluarga dan kroni.

Beliau memberi contoh skandal RM250 juta National Feedlot Corportaion (NFC) melibatkan keluarga bekas Menteri Pembangunan Wanita, Keluarga dan Masyarakat, Datuk Seri Shahrizat Jalil dan terbaru, kontrak membekal bahan api selama enam bulan untuk pesawat MAS yang diberi kepada Petron, milik Mirzan Mahathir.

“Ahli-ahli Umno yang bawah dapat apa? Itupun ahli masih lagi (melaungkan) ‘Hidup Melayu’,” kata Anwar sinis.

29 Jun lalu, Petron dan MAS menandatangani perjanjian bagi membeli dan membekal bahan api untuk pesawat Airbus A380 selama enam bulan berkuatkuasa 1 Julai lalu.

Selain Anwar, turut berucap adalah Pengerusi Majlis Pimpinan KEADILAN Perak, Dr Muhammad Nur Manuty; Ketua Biro Latihan , Mustaffa Kamil Ayub dan Ahli Dewan Undangan Negeri Tronoh, V Sivakumar.

Anwar turut menyampaikan sijil penghargaan kepada Ketua Dewan Himpunan Penyokong PAS Perak, Beh Heng Kin dan Alphonse Arulandu di atas sumbangan mereka kepada Pakatan Rakyat.

HUDUD DAN KETERDESAKAN POLITIK UMNO

Percubaan terkini UMNO menyemai sentimen perkauman dan kesangsian
agama seperti yang dipaparkan menerusi permainan isu Hudud dan Negara
Islam di dalam media-media kawalan UMNO sekali lagi membuktikan gejala
politik melulu yang membudaya di kalangan mereka. Percubaan keji
bersifat ugutan dan hasutan bertujuan membangkitkan persengketaan
agama dan etnik merupakan langkah terdesak untuk mengalih perhatian
rakyat dari isu-isu berkaitan rasuah dan penyalahgunaan kuasa.

Tidak kira bagaimana sesuatu isu itu diputarbelit oleh media kawalan
UMNO, kami dalam Pakatan Rakyat kekal komited terhadap prinsip asas
yang termaktub dalam Perlembagaan Persekutuan; kedudukan Islam sebagai
agama Persekutuan manakala pada masa sama menjamin kebebasan
agama-agama lain untuk diamalkan dalam keadaan aman dan harmoni;
Bahasa Melayu sebagai bahasa kebangsaan dengan kebebasan untuk
menggunakan bahasa ibunda pelbagai kaum; kedaulatan raja-raja Melayu
berserta kedudukan hak istimewa kaum Melayu dan Bumiputera dan hak-hak
kaum lain seperti yang dilindungi oleh Perlembagaan.

Dasar bersama Pakatan Rakyat dan Buku Jingga tetap kekal sebagai
pernyataan rasmi kami tentang kebijakan dan prinsip tadbir urus kami.
Marilah kita mengekalkan tumpuan terhadap agenda perubahan. Kita
seharusnya perlu terus komited dalam meningkatkan daya saing negara,
nilai pendapatan rakyat, mutu pendidikan dan kesihatan serta
peningkatan kos hidup yang semakin membebankan rakyat.

Berkaitan persoalan Shariah, Hudud dan Negara Islam, kami mengiktiraf
serta menghormati perbezaan pandangan dan kedudukan parti-parti
komponen dalam Pakatan Rakyat. Ini mencerminkan penerimaan kami
terhadap amalan konsensus politik. Sebagai seorang Muslim, saya tetap
meyakini al-Quran dan Sunnah; dua asas yang membangunkan
prinsip-prinsip Shariah. Saya percaya bahawa Maqasid al-Shariah adalah
prinsip penting dalam tadbir urus dan tidak bercanggah dengan amalan
demokrasi.

Dalam hal ini, Pakatan Rakyat akan kekal berpandukan prinsip-prinsip
berteraskan keadilan sejagat, tadbir urus yang baik,
kebertanggunjawaban, ketelusan dan keberdayaan dalam usaha memberikan
yang terbaik buat rakyat.

Kita tak seharusnya terpengaruh dengan keterdesakan politik serta
ugutan oleh UMNO-BN. Keyakinan dan kepercayaan sewajarnya diletakkan
terhadap kematangan dan kebijaksaan rakyat untuk menilai dan membuat
pilihan mereka sendiri.

HUDUD AND UMNO'S POLITICS OF DESPERATION

The latest efforts to sow racial and religious distrust as evidenced
by the incessant playing of the issue of Hudud and the Islamic state
in the UMNO controlled media once again underscores the politics of
recklessness. These vile attempts at intimidation, incitement to
religious and ethnic strife are the last desperate attempts to deflect
from issues of corruption and abuse of power.

No matter how the issue is being spun by the UMNO media, we in Pakatan
Rakyat remain committed to the fundamental principles enshrined in the
Federal Constitution; the position of Islam as the religion of the
Federation while guarenteing the freedom of other religions to be
practiced in peace and harmony; Bahasa Melayu as the national language
with liberty to use the mother tongues of the various races;
sovereignty of the Malay rulers together with the position of the
special privileges of the Malays and bumiputras and the rights of
other races as protected by the Constitution.

The Pakatan Rakyat joint policy and the Orange Book remain intact as
clear statements of our policies and principles of governance. Let us
remain focussed on the agenda for change. We need to increase our
competitiveness, the peoples income, quality of education, health and
check the increasing cost of living burdening the people.

As for the Shariah, Hudud, and the Islamic state, we recognise and
respect the different views and positions of the component parties in
the Pakatan Rakyat. This is reflective of the politics of consensus.
As a Muslim, I remain steadfast in my believe in the Quran and the
Sunnah from which the principles of the Shariah are derived. I believe
that the Maqasid al-Shariah (the higher objectives of the Shariah) are
important principles of governance and are not inconsistent with the
precepts of democracy.

In this regard, Pakatan Rakyat will remain guided by the principles of
universal justice, good governance, accountability, transparency and
competency in order to achieve public good for the people.

Let us not be way laid by the politics of desperation and intimidation
of UMNO-BN. Place our trust in the maturity and wisdom of the people
to evaluate this situation and make their independent choice.

Shahrizat’s case closed, Azmin’s case re-opened

The MACC review panel clears the minister of any wrongdoing in the NFC scandal, and at the same time, recommends that the PKR deputy president's case be re-investigated.

The MACC operations review panel has cleared former minister Shahrizat Abdul Jalil of any links with regard to the National Feedlot Centre scandal, in which her husband and children have been implicated.

On another matter, the panel ordered the case against PKR deputy president Azmin Ali to be re-opened based on the fresh information received.

As for Shahrizat’s case, panel chairperson Hadenan Abdul Jalil said: “The panel found that she was not involved in awarding the project to the company (headed by her husband Mohamed Salleh Ismail) and the (government’s) RM250 million loan (for NFC).”

And on Azmin’s case, the MACC reviews panel said that in light of the new evidence produced by blogger Raja Petra Kamarudin, including confidential documents, it had recommended that the case be re-investigated.

Earlier this week, Raja Petra had disclosed several confidential documents which implicated Azmin in corrupt practices in 1995 when he had served as Anwar Ibrahim’s political aide.

After Raja Petra’s exposure, former Anti-Corruption Agency director-general Shafee Yahaya said that following the findings of a probe in 1997, he recommended to then deputy prime minister Anwar to take disciplinary action against Azmin.

MACC’s investigation head Mustafa Ali had told reporters today that the commission might record statements from Anwar and Azmin over the matter.

Raja Petra had said a retired MACC officer had handed him files that showed that the then ACA  had gathered concrete evidence to arrest and prosecute Azmin for corruption.

He alleged that the file was marked ‘no further action’ by Shafee on instructions from Anwar, a charge which Shafee denied.

Azmin was alleged to have receved a monthly stipend of RM15,000 from Berjaya Group tycoon Vincent Tan.

Other files are paper trails showing Azmin and wife, Shamsidar Taharin, owning shares, houses and cars totalling RM1.5 million and about RM10 million in cash.

Sand scandal case closed

At the press conference today, Hadenan admitted that it might be difficult to unearth new evidence given that the case is 17 years old.

However, he vowed that investigations will be fair and would only be based on “solid proof”. He said MACC does not rule out Shafee being be called up to assist in the fresh probe.

Mustafa said that MACC was studying if allegations against Azmin, which the ACA could not find any wrongdoings then, could be investigated under new provisions of the current MACC Act.

Meanwhile, Hadenan said that they have decided to close investigations into allegations of sand theft syndicates in Selangor involving Sri Muda state assemblyperson Mat Shuhaimi Shafiei and Batu Caves state assemblyperson Amirudin Shari.

In February, the panel had recommended that the case be re-opened following allegations by Raja Petra that the duo allegedly colluded with a well-heeled contractor with regard to sand mining operations in the state.

Raja Petra claimed that the contractor forked out cash assistance to Mat Suhaimi for his programmes while Amirudin had provided a supporting letter to Double Dignity Sdn Bhd, the sand mining company belonging to the contractor.

“The legal division, after re-looking at the files, held the same view they did previously – that it needed no further action,” said Hadenan.

The panel is an independent one formed by several people appointed by the government to re-look and review the decision of the A-G. The PPO members are specialists and professionals appointed by the prime minister.

Bad law bites back

BN lawmakers who were keen to shift the burden of proof of innocence to netizens with the Section 114A amendment of the Evidence Act may now find the hammer above their heads instead. An offensive statement posted on an allegedly bogus Umno Youth Facebook page went viral.  The posting in Malay which has since been removed said, "If you agree to make Christianity the official religion of the Federation of Malaysia, continue your support of Pakatan Rakyat."
 
BN Youth maintains innocence over the posting while insisting that the page does not belong to Umno Youth, and had lodged a police report.

This would appear to be the test case under the newly-amended Evidence Act which has come under intense fire. Under the Act, the apparent owner or administrator of a website on which any posting appears is presumed to have made the posting, unless proven otherwise.
 
However, in its investigation of this particular case, the police do not intend to apply Section 114A. The Evidence Act amendment comes in effect only if Umno Youth has been charged under other laws, as the amendment does not presume one's guilt, but presumes the fact of a publication.
 
Opacity still permeates the gazette though. Lawyers are doubtful if a police report suffices to prove one's innocence under Section 114A's presumptions. Also, what is the legal standing of a person whose name was used in the posting of defamatory content, and did not make a police report quickly enough?
 
Malaysians are on edge about Section 114A and the perceived hidden intentions behind its hasty passing. After all, our federal government has a track record of selective prosecution, which some might suggest borders on political persecution.
Did the attorney-general himself breach BAFIA?

Following the arrest of PKR strategic director Rafizi Ramli and a former bank clerk for violating the Banking and Financial Institutions Act (Bafia) when unearthing the dirt on the NFC scandal, former Kuala Lumpur Criminal Investigations Department (CID) chief Mat Zain Ibrahim said that attorney-general Tan Sri Abdul Gani Patail himself should also be charged under Bafia. Gani had revealed confidential banking details during a  previous investigation of a former Malacca chief minister.
 
REFSA has pointed out that the attorney-general can choose not to prosecute the whistleblowers in the Cowgate scandal. There are precedents – he has not prosecuted in other cases where the law had been clearly broken. For instance, Datuk Seri Dr Chua Soi Lek escaped legal action despite a video showing him and a woman engaging in fellatio (oral sex). This is an offense under Section 377A of the Penal code – the same law that opposition leader Datuk Seri Anwar Ibrahim was charged under for alleged sodomy. If Chua's bedroom behaviour can be discounted by the attorney-general, surely Rafizi can be spared charges as well? After all, Rafizi's exposé actually served public interest.

When you can't beat crime, shift it!
 
The pressure on cops to go out and combat crime has prompted them to sit back and dabble in creative accounting instead, according to one "Anonymous Policeman".
 
In a letter to Bukit Bendera MP Liew Chin Tong, the writer alleged that police have been compelled to distort crime statistics because the new Key Performance Index (KPI) set for the police in 2009 – reduce crime by 20 percent – was "absolutely a feat impossible".
 
The writer explained how they rigged the system to 'achieve' the target.  They shifted index crime (from which crime statistics are derived) to non-index crime (which are not included in statistics), closed cases under "no further action" (NFA), selectively opened  cases for investigation, and fed doctored classification of cases into the police computing system to "produce the result that was desired".
 
Various recommendations were made by "Anonymous Police" on how to improve the police force. REFSA suggests adding the redeployment of police force to the list. Our Focus Paper revealed that 41% of our men in blue are in management or administration. This works out to each manager/administrator managing fewer than two subordinates on average! Tradesmen jobs are not jobs for 'losers'

Skilled workers such as mechanics, plumbers or seamstresses should not be seen as inferior to professionals such as lawyers or doctors for they too offer essential services which everyone needs. Hence, don't they deserve the same respect and dignity?

PERUTUSAN EIDULFITR 1433H -- YB DATO' SERI ANWAR IBRAHIM

Alhamdulillah, syukur kepada Allah SWT, Yang Maha Penyayang dan Maha
Mengasihani, kerana dengan limpah kurnia-Nya, kita telah berjaya
menyempurnakan ibadah puasa di bulan Ramadhan yang penuh keberkatan
ini.

Saya dan Azizah mewakili keluarga, kepimpinan dan anggota KEADILAN
seluruhnya ingin mengucapkan Selamat Hari Raya Eidulfitr 1433 Hijrah
kepada semua sahabat handai, rakan taulan serta muslimin muslimat
sekalian dengan lafaz minal eidil walfaizin wal maqbulin. Kemaafan
dipohon daripada saudara-saudari seluruhnya atas sebarang
keterlanjuran kata dan perilaku.

Menjalani ibadah puasa sepanjang bulan Ramadhan merupakan suatu ujian
kepada umat Islam; ujian melawan nafsu yakni musuh utama kita dan
seandainya berjaya, maka kita akan dianugerahi Alllah SWT dengan
petunjuk serta keampunan.

Syawal tahun ini juga masih disambut dengan suasana negara yang parah
dengan penyalahgunaan kuasa; apabila amanah yang diberi rakyat untuk
memimpin dikhianati dengan amalan kronisme dan rasuah, peningkatan
drastik statistik jenayah, politik dendam yang tidak berkesudahan dan
agenda jahat yang bertujuan memecahbelahkan keharmonian sesama kita.

Justeru, marilah kita sama-sama menyambut bulan yang mulia ini dengan
penuh keinsafan, kesederhanaan dan penuh kesabaran. Moga Syawal tahun
ini menguatkan keazaman kita untuk kekal istiqamah dalam menuntut
perubahan serta menggilap semangat perjuangan menegak yang hak dan
yang adil serta menolak kezaliman dan kebobrokan.
